Terms and Conditions for the Newsletter Service (“Terms and Conditions”)

1. These Terms and Conditions define the rules for providing the service of sending content in the form of an electronic letter (“Newsletter”) to interested parties (“User”), the terms for entering into and terminating the agreement for the provision of digital content, under which payment is made in data.
2. The Newsletter is provided by Forever Entertainment Spółka Akcyjna with its registered office in Gdynia, Al. Zwycięstwa 96/98, 81-451 Gdynia, recorded in the National Court Register kept by the District Court Gdańsk-Północ, 8th Commercial Division of the National Court Register under the number KRS: 0000365951, NIP (Tax Identification Number): 5833112205, REGON (Statistical Number) 221122120, with the share capital of PLN 10,880,000, paid up in full, e-mail: newsletter@forever-entertainment.com (“FE”).
3. The Newsletter is sent by FE to the User’s e-mail address and contains commercial information and contents regarding FE products, FE activities and other information about FE. To be able to use the Newsletter service the User has to hold a device allowing to read e-mail messages, has to have access to the Internet and has to hold an active e-mail.
4. Subscription to the Newsletter service is voluntary, and upon successful registration, an agreement for the provision of digital content in exchange for data payment is concluded between FE and the User.
5. The Newsletter service is provided for an indefinite period

6. Each Newsletter contains:

   a. information about FE as the publisher of the Newsletter,
   b. information about the subject, specifying the content of the Newsletter,
   c. information on how to unsubscribe from the Newsletter service.

7. Subscription to the Newsletter service requires registration and further actions at: https://forever-entertainment.com/newsletter,17,en

   a. entering an e-mail address in the appropriate field of the electronic form (please note that providing the e-mail address is required for the provision of the Newsletter service),
   b. having read the Terms and Conditions for the Newsletter Service, the Privacy Policy and the Cookies Policy,
   c. ticking the box “I want to receive the Newsletter”,
   d. submitting statements and expressing consents required in the registration process,
   e. acknowledgement of having read the Terms and Conditions for the Newsletter Service, the Privacy Policy and the Cookies Policy,
   f. clicking the “Subscribe!” button,
   g. acknowledgement of the launch of the Newsletter service by clicking the link in the e-mail sent by FE. By proceeding with this action the User activates a dispatch of the FE Newsletter to the indicated e-mail address and confirms his/her will to receive the Newsletter. A failure to confirm the activation of the Newsletter service results in the deletion of the e-mail address recorded.

8. A controller of the personal data as defined in the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (EU OJ L 268, of 2016, 119, hereinafter: GDPR), provided during the use of the Newsletter service and when submitting complaints (if any), is Forever Entertainment Spółka Akcyjna (FE) with its registered office in Gdynia, Al. 9. FE processes collected personal data in accordance with the Act on the Provision of Electronic Services of July 18, 2002, GDPR, the Personal Data Protection Act of May 10, 2018, and the Electronic Communications Law of July 12, 2024.
10. Personal data are processed by Forever Entertainment Spółka Akcyjna with its registered office in Gdynia for the purpose of providing the Newsletter (including for the purpose of direct marketing of the data controller’s products and services, providing commercial information by electronic means of communication, using telephone terminal equipment for direct marketing purposes), processing any submitted complaints (including for the purpose of providing information on the resolution of the complaint) and achieving the purposes resulting from the legitimate interests pursued by the data controller.
11. A legal basis for the processing of personal data by the data controller is a consent to the processing of personal data (Article 6 (1) (a) of the GDPR, in the scope of data processing for the purpose of providing the Newsletter, including consent to direct marketing of the data controller's products and services, consent to the provision of commercial information by electronic means of communication, consent to the use of telephone terminal equipment for direct marketing purposes), fulfilment of the legal obligation incumbent on the controller (Article 6 (1) (c) of the GDPR, in the scope of data processing for the purpose of examining any submitted complaints and providing information on the resolution of complaints), legitimate interest of the controller (Article 6 (1) (f) of the GDPR, in order to manage, pursue and defend against mutual claims, including when considering a complaint and to demonstrate the legality of any personal data processing operations).
12. Providing data is voluntary, it is not a statutory or contractual requirement but, without providing them, it is not possible to implement the Newsletter service and it is not possible either to examine any complaint (including to service a notice on the resolution of the complaint).
13. Any and all complaints related to the Newsletter service should be sent to the e-mail address: support@forever-entertainment.com, by post to the FE address indicated in these Terms and Conditions or in person at the registered office of FE. Each complaint should contain a description of problems or irregularities, the e-mail address provided in the process of registering to the Newsletter service and should indicate a method for delivering an answer to the complaint to the User and an address to which the answer to the complaint is to be delivered. The complaints are answered by FE immediately, however no later than within 14 days of the date of receipt of such complaint.
14. Personal data are stored until the consent is withdrawn or until the User directly unsubscribes from the Newsletter service. In the scope of personal data necessary for managing, pursuing and defending in the event of mutual claims, such personal data are stored until the expiry of any mutual claims. After withdrawal of consent or after the User unsubscribes from the Newsletter service, the data covered by the consent are stored for a period of 5 years from the last use of the data for marketing purposes - in this respect, a legal basis for processing by the controller is Article 6 (1) (f) of the GDPR, and the legitimate interest of the controller is the ability to demonstrate the legality of the personal data processing operations.
15. The consent provider has the right to withdraw consent at any time without affecting the legality of the processing conducted based on the consent prior to its withdrawal. A statement on the withdrawal of consent for data processing should be directed to the email address: support@forever-entertainment.com. To unsubscribe from the Newsletter, click the link in the footer of each Newsletter indicating that you may unsubscribe (UNSUBSCRIBE!). Performing this action will remove the email address from the list, and FE will stop sending the Newsletter. The User may also unsubscribe by sending a resignation to the email address: support@forever-entertainment.com or by traditional mail to the FE address provided in point 2 of the Terms and Conditions. Unsubscribing from the Newsletter results in the termination of the agreement between FE and the User.
16. Recipients of personal data, categories of recipients - Personal data may be disclosed by the data controller on the basis of a data processing agreement, in accordance with applicable laws in the field of personal data protection, to an entity providing IT services for the Newsletter service (Freshmail sp. z o.o., Al. 29 Listopada 155 c, 31-406 Kraków) and any other entities authorised under the law. Personal data will be processed on behalf of the data controller by any and all authorised employees.
17. Personal data will not be transferred to third countries or international organisations.
18. Pursuant to the regulations on the protection of personal data, you have the right to access your data and the right to rectify, delete or restrict data processing, the right to object to processing and the right to transfer data. In addition, you also have the right to lodge a complaint with the supervisory authority (the President of the Office for Personal Data Protection) when you consider that the processing of your personal data by the controller violates the regulations on the protection of personal data.
19. Please note that the User has the right to change the e-mail address indicated in the form during the registration activities. In order to change the address, please write a message to the e-mail address: support@forever-entertainment.com with information about the change of the e-mail address.
20. Please note that a person who, when registering, provides an e-mail address of a third party without their knowledge and consent, is liable for damages towards FE as the publisher of the Newsletter in the event of any claims against FE raised by such third party.
21. No automated decisions, including profiling, are made on the basis of personal data.
22. Please note that when using the Newsletter service, the User is prohibited from providing and transmitting any unlawful content.
23. Please note that the use of the Newsletter service may involve standard risks related to the use of the Internet and recommends the User to take appropriate steps to minimise the same.
24. FE reserves the right to amend these Terms and Conditions. Any amendments to the Terms and Conditions are notified by FE by publishing at http://forever- entertainment.com/pl.newsletter.html a notice about the amendment to the Terms and Conditions and by sending an e-mail to the User to the e-mail address provided during the registration process.

27. FE reserves the right to discontinue the provision of the Newsletter service without giving reasons, after a prior e-mail notice to the User.
28. A User who is a consumer, after exhausting the complaint procedure outlined in these Terms and Conditions, has the option of using alternative dispute resolution for complaints and claims before a permanent consumer arbitration court or contacting the Provincial Trade Inspectorate, the district (municipal) consumer ombudsman, a social organization, or utilizing the ODR platform (http://ec.europa.eu/consumers/odr).
