The controller of personal data within the meaning of REGULATION (EU) 2016/679 OF THE

The controller processes the personal data collected in accordance with the Act of 18 July 2002 on the
provision of electronic services (Journal of Laws of the Republic of Poland of 2017, item 1219, as
amended), GDPR, Personal data protection Act of May 10, 2018 (Journal of Laws of the Republic of
Poland of …….) and the Act of July 16, 2004. Telecommunication law (Journal of Laws of the Republic of Poland of 2017, item 1907, as amended).
Personal data will be processed by Forever Entertainment Spółka Akcyjna with its registered office in
Gdynia to provide the Newsletter (including direct marketing of products and services of the controller,
transmission of commercial information via electronic means of communication, use of telephone
terminal equipment for direct marketing purposes), consideration of the complaints (including providing information about the result of consideration of the complaint) and to achieve the objectives resulting from legally legitimate interests pursued by the controller.
The legal basis for the processing of personal data by the data controller is the consent to the processing
of personal data (GDPR: Article 6 paragraph 1 letter a), within the scope of processing personal data to
deliver Newsletter, including consent for direct marketing of data administrator products and services,
consent for transfer of commercial information by means of electronic communication, consent for use
of telephone terminal equipment for direct marketing purposes), processing is necessary for compliance
with a legal obligation to which the controller is subject (GDPR: Article 6 paragraph 1 letter c, within
the scope of processing personal data for the purpose of considering the complaint and providing
information on the result of consideration of complaint), processing is necessary for the purposes of the
legitimate interests pursued by the controller (GDPR: Article 6 paragraph 1 letter f, within the scope of
considering, investigation and defense in the event of mutual claims, including consideration of
complaints as well as within the scope of proving the legality of processing of personal data).
Providing personal data is voluntary, it is not a statutory or contractual requirement, however, without
providing it, it is not possible to provide the Newsletter service and it will not be possible to consider the complaint (including notification on the result of consideration of complaint).
Personal data will be stored until withdrawal of consent or by resignation from the Newsletter service.
To the extent, personal data is necessary to consider, investigate and defend against mutual claims such,
personal data will be stored until the mutual claims expire. After the withdrawal of consent or by
resignation from the Newsletter service personal data covered by consent will be stored for the period of 5 years since last use for marketing purposes – within that scope the legal basis for the processing of
personal data by the data controller is GDPR: Article 6 paragraph 1 letter f, and the legitimate interest of controller is proving the legality of processing of personal data.
The consenting subject of personal data has the right to withdraw the consent at any time without
affecting the lawfulness of the processing which was made on the basis of the consent prior to its

The recipients, categories of recipients of the personal data - Personal data may be disclosed by the
controller on basis of the agreement on the data processing, in accordance with the applicable law
applying to personal data protection, to the entity providing IT services to the Newsletter (Freshmail sp.
z o. o., Al. 29 November 155 c, 31-406 Kraków) or other entities authorized under the law. Personal
data will be processed on behalf of the controller by authorized employees.
Personal data will not be transferred to a third country or to an international organisation.
According to terms and provisions of the protection of personal data regulations, you have the right to
access your data and the right to rectification, erasure or restriction of data processing, the right to object to the processing and the right to data portability. In addition, you also have the right to lodge a
complaint to the supervisory authority (President of the personal data protection authority) when you
claim that the processing of your personal data by the controller violates the regulations on the
protection of personal data.
No automated decision-making, including profiling, will be carried out on the basis of personal data.
